Does 31 CFR § 560.540 of the Iranian Transactions and Sanctions Regulations (ITSR) authorize the exportation to Iran and importation into the United States or a third country of communication devices by persons travelling to and from Iran?

OFAC's answer

Yes. Section [560.540](https://www.ecfr.gov/current/title-31/subtitle-B/chapter-V/part-560) of the ITSR authorizes the exportation, reexportation, or provision to Iran and the importation into the United States by an individual entering the United States directly or indirectly from Iran, of hardware and software authorized by paragraphs 31 CFR § [560.540(a)](https://www.ecfr.gov/cgi-bin/retrieveECFR?gp=&SID=e3c4494665db57ce61ce4c1445726e8e&mc=true&r=PART&n=pt31.3.560#se31.3.560_1540)(2) or (a)(3). See Note 1 to paragraphs (a)(2) and (a)(3) of 31 CFR § 560.540. Section 560.540 also authorizes the importation into the United States by an individual entering the United States, directly or indirectly, from Iran, of hardware or software authorized by 31 CFR § 560.540(a)(2) or (a)(3), provided the items were previously exported, reexported, or provided to Iran under an authorization issued pursuant to the ITSR.
