ActiveAuthorizing Transactions Involving Certain Government of Venezuela Persons
Summary
General License 34A authorizes transactions and activities otherwise prohibited by E.O. 13884 involving certain individuals who meet the definition of 'Government of Venezuela,' including U.S. citizens, permanent resident aliens, valid visa holders, former employees/contractors, and current employees/contractors providing health or education services in Venezuela. It also authorizes receipt of salary, pension, annuity, or other employment-related payments from blocked Government of Venezuela entities for those qualifying individuals. Additionally, it authorizes transactions necessary to unblock property or interests in property that were blocked solely pursuant to E.O. 13884 for those individuals. This license replaced and superseded General License 34 dated September 9, 2019.
Authorized activities
- All transactions and activities prohibited by E.O. 13884 involving U.S. citizens who meet the definition of Government of Venezuela
- All transactions and activities prohibited by E.O. 13884 involving permanent resident aliens of the United States who meet the definition of Government of Venezuela
- All transactions and activities prohibited by E.O. 13884 involving individuals with a valid U.S. immigrant or nonimmigrant visa (excluding UN mission members) who meet the definition of Government of Venezuela
- All transactions and activities prohibited by E.O. 13884 involving former employees and contractors of the Government of Venezuela
- All transactions and activities prohibited by E.O. 13884 involving current employees and contractors of the Government of Venezuela who provide health or education services in Venezuela
- Receipt of salary, pension, annuity, or other employment-related payments or benefits from a blocked Government of Venezuela person by qualifying individuals
- Transactions necessary to unblock property or interests in property blocked solely pursuant to E.O. 13884 for qualifying individuals, including the return or processing of funds
Conditions
This license does not authorize: (1) unblocking of any property blocked pursuant to E.O. 13884 or 31 C.F.R. chapter V except as specified in paragraphs (a), (b), or (c); (2) any transactions otherwise prohibited by E.O. 13884 or related Executive Orders (13850, 13835, 13827, 13808, 13692, each as amended by E.O. 13857), or dealings with any blocked person other than those described in paragraph (a); or (3) any transactions with or unblocking of property of any person on OFAC's SDN List. Individuals in the United States as part of Venezuela's mission to the United Nations are excluded from the valid visa holder category.
Reporting requirement
U.S. persons unblocking property pursuant to paragraphs (a), (b), or (c) must, within 10 business days from the date the property is unblocked, file a report detailing the information required by 31 C.F.R. § 501.603(b)(3)(ii) with the Office of Foreign Assets Control, Office of Compliance and Enforcement, U.S. Department of the Treasury, 1500 Pennsylvania Avenue N.W., Freedman's Bank Building, Washington, DC 20220, or via email to OFACReport@treasury.gov.
