Summary

General License No. 40C authorizes all transactions ordinarily incident and necessary to the provision, exportation, or reexportation of goods, technology, or services to ensure the safety of civil aviation involving one or more of the blocked entities listed in the Annex, where those transactions would otherwise be prohibited by E.O. 14024. The authorization applies only where the aircraft is registered outside the Russian Federation and is operated solely for civil aviation purposes. This license replaces and supersedes General License No. 40B, dated August 3, 2022, effective November 14, 2022.

Authorized activities

  • Provision of goods, technology, or services to ensure the safety of civil aviation involving blocked entities listed in the Annex
  • Exportation of goods, technology, or services to ensure the safety of civil aviation involving blocked entities listed in the Annex
  • Reexportation of goods, technology, or services to ensure the safety of civil aviation involving blocked entities listed in the Annex

Conditions

Two affirmative conditions must be met: (1) the aircraft must be registered in a jurisdiction solely outside of the Russian Federation; and (2) the goods, technology, or services provided, exported, or reexported must be for use on aircraft operated solely for civil aviation purposes. The license does not authorize transactions prohibited by Directive 2 under E.O. 14024 (correspondent/payable-through accounts), Directive 4 under E.O. 14024 (Central Bank of Russia, National Wealth Fund, or Ministry of Finance of Russia), or any other transactions prohibited by the RuHSR involving persons blocked under the RuHSR other than the Annex-listed entities, unless separately authorized. Compliance with other Federal laws and agency requirements, including BIS export licensing under the EAR (15 CFR parts 730–774), is still required.
