Summary

This license authorizes non-U.S. persons to reexport eligible fixed-wing civil aircraft (U.S.-origin or with 10%+ U.S.-controlled content, classified under ECCN 9A991.b) to Iran on temporary sojourn, subject to strict operational control criteria. It also authorizes the reexportation of onboard supplies, spare parts, components, and technology for permanent use on the eligible aircraft, as well as technology for emergency maintenance and repairs. The license does not permit U.S. persons to engage in any covered transactions, and is suspended indefinitely effective September 8, 2026.

Authorized activities

• Reexportation by a non-U.S. person of Eligible Aircraft to Iran on temporary sojourn
• Reexportation of usual and reasonable quantities of industry standard onboard supplies of civil aircraft equipment, spare parts, components, and technology for permanent use on the Eligible Aircraft
• Reexportation of technology for purposes of emergency maintenance on and/or repairs to an Eligible Aircraft reexported to Iran

Conditions

Nine criteria must all be satisfied: (1) the non-U.S. person reexporter retains the right to hire/fire cockpit crew; (2) retains the right to dispatch the aircraft; (3) retains the right to determine routes; (4) retains the right to perform or obtain principal maintenance, which must occur outside Iran under a non-Iranian-resident party's control; (5) aircraft registration must not change to Iran; (6) no technology transfer to an Iranian national ordinarily resident in Iran; (7) aircraft may not bear the color, livery, or logo of any Iranian air carrier; (8) aircraft may not be equipped with or used to transport arms, USML-controlled items, ECCN 0A-E521 or 600-series items, or WMD-related items; (9) aircraft may be in Iran no more than 72 hours per temporary sojourn. U.S. persons are entirely excluded, U.S.-registered aircraft are excluded, and the sale, lease, or transfer of operational control is not authorized.
