Summary

General License No. 104A authorizes transactions ordinarily incident and necessary to the importation and entry into the United States of certain non-industrial diamonds that were physically located outside of Russia before specified cutoff dates and have not been exported or re-exported from Russia since those dates. The authorization covers non-industrial diamonds of 1.0 carat or greater that were outside Russia before March 1, 2024, and non-industrial diamonds of 0.5 carats or greater that were outside Russia before September 1, 2024. The license does not authorize importation of non-industrial diamonds of Russian Federation origin, which remains prohibited under E.O. 14068. This license supersedes General License No. 104 dated August 23, 2024.

Authorized activities

• Importation and entry into the United States of non-industrial diamonds (1.0 carat or greater) physically located outside Russia before March 1, 2024 and not exported/re-exported from Russia since that date
• Importation and entry into the United States of non-industrial diamonds (0.5 carats or greater) physically located outside Russia before September 1, 2024 and not exported/re-exported from Russia since that date
• Importation for admission into a foreign trade zone located in the United States of the above-described diamonds
• All transactions ordinarily incident and necessary to the above importation activities

Conditions

Diamonds must have been physically located outside of the Russian Federation before March 1, 2024 (for diamonds 1.0 carat or greater) or before September 1, 2024 (for diamonds 0.5 carats or greater), and must not have been exported or re-exported from the Russian Federation since those respective dates. The license does not authorize transactions otherwise prohibited by the RuHSR, including transactions involving any person blocked pursuant to the RuHSR, unless separately authorized. Importation of non-industrial diamonds of Russian Federation origin remains prohibited. Compliance with all other Federal laws and requirements of other Federal agencies is still required.
